Privacy Policy

The following policy sets forth how PRI·MED Medical Products Inc. (“PRI·MED”) collects, uses and discloses the information about PRI·MED customers and their authorized representatives (“Customers”) that PRI·MED collects on this website (“Customer Information”). This policy applies to PRI·MED and any web sites related to operation of PRI·MED and the goods and services it provides to Customers (“PRI·MED Services”).

INFORMATION COLLECTED
During Customer registration, PRI·MED collects identifiable information, including, but not limited to the personal information identified here. Personal Information includes name, work postal address, e-mail address, phone number, employer identification number (if any), credit card or bank account information (when required), the names of principal authorized representatives who will work with PRI·MED (when applicable), and any other information PRI·MED reasonably requires in order to provide access to PRI·MED’s services to its Customers.

Except where required or permitted by law, PRI·MED will collect, use or disclose Customer’s personal information only with Customer’s knowledge and consent, either express or implied. PRI·MED will not make Customer’s consent a requirement to the supply of a product or a service other than required to be able to supply the product or service. Express consent is given in writing, by using or not using a check-off box, electronically, orally (in person or by telephone), or by Customer’s conduct, such as use of a product or service. In determining the type of consent to obtain, PRI·MED will consider all relevant factors, including the sensitivity of the information and Customer’s reasonable expectations.

PRI·MED does not collect names, postal or e-mail addresses, and phone numbers of non-Customer visitors to PRI·MED’s Web site, except to complete pending registration applications, to provide access to product demonstrations, or to respond to inquiries regarding the PRI·MED Services.

PRI·MED also collects information necessary to process payment transactions for its Customers, including the amount of the Customer’s payments, the credit card or bank accounts to be debited and credited and remittance information necessary to allow correct crediting of Customer’s payments (together “Payment Information”).

PRI·MED may retain copies of any communications PRI·MED sends to or receives from Customers and other visitors to our site for our records, but may not use any such information except in accordance with the terms of PRI·MED’s Privacy Policy.

USE OF COLLECTED INFORMATION
Unless the purpose for collecting information is self-evident due to the nature of any individual transaction, PRI·MED will identify the purposes for which personal information is collected at or before the time the information is collected. An example of a self-evident purpose is requesting the name and address of the person placing an order in order to ensure proper delivery and requesting credit card information to process a payment.

PRI·MED uses information it collects from Customers in connection with payment transactions to complete the transactions. PRI·MED may use such information to operate, maintain and enhance the PRI·MED Services and other services offered by PRI·MED. PRI·MED also uses such information to bill Customers for their use of PRI·MED’s services and to monitor compliance with the rules and policies of the PRI·MED Services.

PRI·MED may use trusted third parties to act on PRI·MED’s behalf by performing such functions as fulfilling orders, delivering packages, processing credit card payments or providing customer service, contractual or other. When PRI·MED uses such third parties, PRI·MED uses appropriate means to ensure compliance by such third parties with this Policy and applicable privacy laws.

PRI·MED compiles and analyzes its Customers’ information into aggregated research reports. Except as may be otherwise agreed in a separate agreement between PRI·MED and any Customer, PRI·MED may share this aggregated data with its business partners. However, except as set forth below, aggregated information is not identified with any particular Customer.

CUSTOMER ACCESS, UPDATE OR DELETION OF INFORMATION COLLECTED BY PRI·MED
Upon written request, PRI·MED will provide to Customer a summary of any Customer Information retained by PRI·MED regarding the Customer. However, in certain circumstances permitted by law, Customer Information will not be disclosed to Customer. Some examples of these circumstances are information that contains references to other individuals, that cannot be disclosed for legal, security or commercial proprietary reasons, or that is subject to solicitor-client or litigation privilege.

PRI·MED will keep Customer’s personal information as accurate, complete and up-to-date as necessary for the purposes for which it is to be used provided that Customer comply with its responsibility to keep certain information current. Customers may correct, change or update the Customer Information at www.primed.ca. Customers who need assistance to change sensitive information should contact PRI·MED’s Privacy Officer for assistance. (Sensitive data including user names, passwords, bank accounts and similar information should NOT be sent via unsecure email).

Customer may withdraw Customer’s consent to collect or hold personal information at any time, on reasonable notice, subject to legal or contractual restrictions.

PRI·MED does not knowingly collect or solicit personal information from anyone under the age of eighteen or knowingly allow such persons to register with PRI·MED on the PRI·MED Services. If Customer is under the age of eighteen, please do not attempt to register or send any information about yourself to PRI·MED, including Customer’s name, address, telephone number, or email address. In the event that PRI·MED learns that PRI·MED has collected personal information from an individual under the age of eighteen, PRI·MED will remove that information as quickly as possible. If Customer believes that PRI·MED might have any information from or about a person under the age of eighteen, please contact PRI·MED.

INFORMATION SHARING
PRI·MED and its authorized representatives have access to the Customer Information. PRI·MED will not disclose, sell, rent, license, exchange or release Customer Information to third parties except when PRI·MED has permission or when PRI·MED believes in good faith that the law requires it or under the circumstances described below.

PRI·MED may disclose Customer Information when PRI·MED has reason to believe that disclosing Customer Information is necessary to identify, contact or bring legal action against someone who may be violating the Terms of Use for the PRI·MED Services or may be causing injury to or interference (either intentionally or unintentionally) with PRI·MED rights or property, other PRI·MED Customers, or anyone else who could be harmed by such activities.

From time to time, PRI·MED may retain the services of third-party service providers and consultants. PRI·MED may allow these third parties to access Customer Information, but only to the extent required to perform the tasks PRI·MED has retained them to perform that may include certain operations for the PRI·MED Services. PRI·MED’s shall require such third parties to agree to maintain the confidentiality of Customer Information in compliance with the terms of this Privacy Policy.

Cookies are small digital files which are temporarily stored on a user’s computer. Cookies are designed to hold a modest amount of data specific to a particular customer and their usage with a website.

Why PRI·MED Uses Cookies
Like most websites you visit, PRIMED.ca uses cookies to improve the user experience for both one-time and repeated visits to the website. CUSTOMER CHOICES REGARDING COLLECTION, USE AND DISTRIBUTION OF CUSTOMER INFORMATION
By accepting the terms of the Terms of Use for the PRI·MED Services and becoming a Customer, each Customer agrees that PRI·MED may collect certain information (as detailed in this Privacy Policy) from and about the Customer to authenticate the Customer and enroll the Customer as a user of the PRI·MED Services. If a prospective Customer does not agree to this Privacy Policy, it may not become a Customer.

PRI·MED may offer a Customer during registration or, through a follow-on email, the opportunity to receive offers and information about products and services from PRI·MED and its partners that PRI·MED believes may be of interest to the Customer. The Customer will be provided a choice whether to accept or not accept this offer. If Customer accepts, PRI·MED (or agents working on behalf of PRI·MED) may occasionally send the Customer such information. If this offer is not accepted, then Customer will not receive such information. If Customer initially accepts, Customer will be provided opportunity to discontinue receiving such information each time it is sent.

CUSTOMER CONTACT
PRI·MED reserves the right to contact Customers regarding account status and changes to the Terms of Use for the PRI·MED Services, this Privacy Policy, or any other policies or agreements relevant to Customers.

SECURITY PRECAUTIONS
User connections to the PRI·MED Services are through a secure Web site. PRI·MED also takes other protective measures related to information security within the PRI·MED Services to ensure the confidentiality of sensitive Customer Information while stored or in use within the PRI·MED Services.

This Privacy Policy covers exchanges of information within the PRI·MED web sites. The PRI·MED sites may contain links to other sites but PRI·MED is not responsible for the privacy practices or the content of such sites.

CHANGES TO THE PRIVACY POLICY
This Policy is subject to applicable privacy laws and PRI·MED’s right to change it at any time. PRI·MED may change this Privacy Policy at any time and will post the changes to the Privacy Policy on our Web sites. Any change to this Privacy Policy will become effective ten (10) business days after it is initially posted on our Web sites unless otherwise agreed with you in writing. Continued use of the PRI·MED Services following such period will mean that the Customer accepts such changes. If a Customer does not agree to any such change, it must terminate its agreement with PRI·MED and cease using the PRI·MED Services.
