PriMED Privacy Policy
The following policy sets forth how priMED Medical Products Inc. ("priMED") collects, uses and discloses the information about priMED customers and their authorized representatives (“Customers”) that priMED collects on this website (“Customer Information”). This policy applies to priMED and any web sites related to operation of priMED and the goods and services it provides to Customers (“priMED Services”).
Information Collected.
During Customer registration, priMED collects identifiable information, including, but not limited to the personal information identified here. Personal Information includes name, work postal address, e-mail address, phone number, employer identification number (if any), credit card or bank account information (when required), the names of principal authorized representatives who will work with priMED (when applicable), and any other information priMED reasonably requires in order to provide access to priMED’s services to its Customers.
Except where required or permitted by law, priMED will collect, use or disclose Customer’s personal information only with Customer’s knowledge and consent, either express or implied. priMED will not make Customer’s consent a requirement to the supply of a product or a service other than required to be able to supply the product or service. Express consent it given in writing, by using or not using a check-off box, electronically, orally (in person or by telephone), or by Customer’s conduct, such as use of a product or service. In determining the type of consent to obtain, priMED will consider all relevant factors, including the sensitivity of the information and Customer’s reasonable expectations.
priMED does not collect names, postal or e-mail addresses, and phone numbers of non-Customer visitors to priMED's Web site, except to complete pending registration applications, to provide access to product demonstrations, or to respond to inquiries regarding the priMED Services.
priMED also collects information necessary to process payment transactions for its Customers, including the amount of the Customer's payments, the credit card or bank accounts to be debited and credited and remittance information necessary to allow correct crediting of Customer’s payments (together “Payment Information”).
priMED may retain copies of any communications priMED sends to or receives from Customers and other visitors to our site for our records, but may not use any such information except in accordance with the terms of priMED’s Privacy Policy.
Use of Collected Information.
Unless the purpose for collecting information is self-evident due to the nature of any individual transaction, priMED will identify the purposes for which personal information is collected at or before the time the information is collected. An example of a self-evident purpose is requesting the name and address of the person placing an order in order to ensure proper delivery and requesting credit card information to process a payment.
priMED uses information it collects from Customers in connection with payment transactions to complete the transactions. priMED may use such information to operate, maintain and enhance the priMED Services and other services offered by priMED. priMED also uses such information to bill Customers for their use of priMED’s services and to monitor compliance with the rules and policies of the priMED Services.
priMED may use trusted third parties to act on priMED’s behalf by performing such functions as fulfilling orders, delivering packages, processing credit card payments or providing customer service, contractual or other. When priMED uses such third parties, priMED uses appropriate means to ensure compliance by such third parties with this Policy and applicable privacy laws.
priMED compiles and analyzes its Customers’ information into aggregated research reports. Except as may be otherwise agreed in a separate agreement between priMED and any Customer, priMED may share this aggregated data with its business partners. However, except as set forth below, aggregated information is not identified with any particular Customer.
Customer access, update or deletion of information collected by priMED.
Upon written request, priMED will provide to Customer a summary of any Customer Information retained by priMED regarding the Customer. However, in certain circumstances permitted by law, Customer Information will not be disclosed to Customer. Some examples of these circumstances are information that contains references to other individuals, that cannot be disclosed for legal, security or commercial proprietary reasons, or that is subject to solicitor-client or litigation privilege.
priMED will keep Customer’s personal information as accurate, complete and up-to-date as necessary for the purposes for which it is to be used provided that Customer comply with its responsibility to keep certain information current. Customers may correct, change or update the Customer Information at www.primed.ca. Customers who need assistance to change sensitive information should contact priMED’s Privacy Officer [link] for assistance. (Sensitive data including user names, passwords, bank accounts and similar information should NOT be sent via unsecure email).
Customer may withdraw Customer’s consent to collect or hold personal information at any time, on reasonable notice, subject to legal or contractual restrictions.
priMED does not knowingly collect or solicit personal information from anyone under the age of eighteen or knowingly allow such persons to register with priMED on the priMED Services. If Customer is under the age of eighteen, please do not attempt to register or send any information about yourself to priMED, including Customer’s name, address, telephone number, or email address. In the event that priMED learns that priMED has collected personal information from an individual under the age of eighteen, priMED will remove that information as quickly as possible. If Customer believes that priMED might have any information from or about a person under the age of eighteen, please contact priMED.
Information Sharing.
priMED and its authorized representatives have access to the Customer Information. priMED will not disclose, sell, rent, license, exchange or release Customer Information to third parties except when priMED has permission or when priMED believes in good faith that the law requires it or under the circumstances described below.
priMED may disclose Customer Information when priMED has reason to believe that disclosing Customer Information is necessary to identify, contact or bring legal action against someone who may be violating the Terms of Use for the priMED Services or may be causing injury to or interference (either intentionally or unintentionally) with priMED rights or property, other priMED Customers, or anyone else who could be harmed by such activities.
From time to time, priMED may retain the services of third-party service providers and consultants. priMED may allow these third parties to access Customer Information, but only to the extent required to perform the tasks priMED has retained them to perform that may include certain operations for the priMED Services. priMED's shall require such third parties to agree to maintain the confidentiality of Customer Information in compliance with the terms of this Privacy Policy.
Cookies.
priMED’s Web site(s) may use cookies to recognize each Customer as an authorized user of the priMED Services, and allow us to provide customized services and improve the performance and usability of our website(s). We may offer certain features that are only available through the use of a "cookie". You are always free to decline our cookies if your browser permits, although in that case you may not be able to use certain features on our website(s).
Customer choices regarding collection, use and distribution of Customer Information.
By accepting the terms of the Terms of Use for the priMED Services and becoming a Customer, each Customer agrees that priMED may collect certain information (as detailed in this Privacy Policy) from and about the Customer to authenticate the Customer and enroll the Customer as a user of the priMED Services. If a prospective Customer does not agree to this Privacy Policy, it may not become a Customer.
priMED may offer a Customer during registration or, through a follow-on email, the opportunity to receive offers and information about products and services from priMED and its partners that priMED believes may be of interest to the Customer. The Customer will be provided a choice whether to accept or not accept this offer. If Customer accepts, priMED (or agents working on behalf of priMED) may occasionally send the Customer such information. If this offer is not accepted, then Customer will not receive such information. If Customer initially accepts, Customer will be provided opportunity to discontinue receiving such information each time it is sent.
Customer Contact.
priMED reserves the right to contact Customers regarding account status and changes to the Terms of Use for the priMED Services, this Privacy Policy, or any other policies or agreements relevant to Customers.
Security Precautions.
User connections to the priMED Services are through a secure Web site. priMED also takes other protective measures related to information security within the priMED Services to ensure the confidentiality of sensitive Customer Information while stored or in use within the priMED Services.
This Privacy Policy covers exchanges of information within the priMED web sites. The priMED sites may contain links to other sites but priMED is not responsible for the privacy practices or the content of such sites.
Changes to the Privacy Policy.
This Policy is subject to applicable privacy laws and priMED's right to change it at any time. priMED may change this Privacy Policy at any time and will post the changes to the Privacy Policy on our Web sites. Any change to this Privacy Policy will become effective ten (10) business days after it is initially posted on our Web sites unless otherwise agreed with you in writing. Continued use of the priMED Services following such period will mean that the Customer accepts such changes. If a Customer does not agree to any such change, it must terminate its agreement with priMED and cease using the priMED Services.
